At The Ocean Collective GmbH, safety comes first – this applies on deck as well as with your booking.
Since we are a tour operator based in Germany, you enjoy the full protection of the [relevant legal provisions]. European package travel law. This is one of the highest consumer protection standards in the world. Among other things, it guarantees that your payments are protected against insolvency and that you have clear rights in the event of changes to the services.
The law requires us to provide you with the following official form before booking. It reads somewhat bureaucratically, but it serves to inform and protect you.
Standard form for informing the traveler on a package tour
The combination of travel services offered to you constitutes a package tour within the meaning of Directive (EU) 2015/2302.
Therefore, you can claim all EU rights that apply to package holidays. The company The Ocean Collective GmbH, Paulinenallee 49, 22769 Hamburg, bears full responsibility for the proper execution of the entire package tour.
In addition, the The Ocean Collective GmbH about the legally required protection for the repayment of your payments and, if transport is included in the package tour, to ensure your return transport in the event of their insolvency.
Key rights under Directive (EU) 2015/2302:
The travelers receive all essential information about the package tour before concluding the package tour contract.
At least one entrepreneur is always liable for the proper provision of all travel services included in the contract.
Travelers will be given an emergency telephone number or details of a contact point through which they can get in touch with the tour operator or travel agency.
The travelers can transfer the package tour to another person – within a reasonable period and possibly at additional cost.
The price of a package holiday may only be increased if certain costs (for example, fuel prices) increase and if this is expressly stipulated in the contract, and in any case no later than 20 days before the start of the package holiday. If the price increase exceeds the package holiday price, the traveler may withdraw from the contract. If a tour operator reserves the right to increase the price, the traveler has the right to a price reduction if the corresponding costs decrease.
Travelers can withdraw from the contract without paying a cancellation fee and receive a full refund of all payments if any of the essential elements of the package tour, with the exception of the price, are significantly altered. If the tour operator responsible for the package tour cancels the package tour before its commencement, travelers are entitled to a refund and, under certain circumstances, compensation.
Travelers may cancel their package holiday without paying a cancellation fee if extraordinary circumstances arise before the start of the trip, for example, if there are serious security problems at the destination that are likely to affect the package holiday.
Furthermore, travelers can withdraw from the contract at any time before the start of the package tour by paying a reasonable and justifiable cancellation fee.
If, after the start of the package tour, essential elements of the package tour cannot be provided as agreed, the traveler must be offered suitable alternative arrangements at no extra cost. The traveler may withdraw from the contract without paying a cancellation fee (in Germany, this right is called "termination") if services are not provided in accordance with the contract and this has a significant impact on the performance of the contractual package tour services, and the tour operator fails to remedy the situation.
The traveler is entitled to a price reduction and/or compensation if the travel services are not provided or not provided properly.
The tour operator provides assistance to the traveler if he or she is in difficulty.
In the event of the insolvency of the tour operator or – in some Member States – the travel agent, payments will be refunded. If the insolvency of the tour operator or, where applicable, the travel agent occurs after the start of the package tour and transport is part of the package tour, the return transport of the travelers will be guaranteed. Travelers can contact this institution or, if applicable, the relevant authority if they are denied services due to the insolvency of The Ocean Collective GmbH.
